Texas man, fellow homeschooler, a man after my own heart, and today's podcast guest, Jesse Elder is a self-described “Millionaire Mentor,” an Improv Philosopher, a former MMA fighter turned entrepreneur, and also the author of the online course “The Upgraded Life.”

Jesse's latest quest has been to tackle our human rights, sovereignty, common law vs. statutory law, and many other elements of freedom that are particularly relevant for the times we are currently living in.

During our discussion, you'll discover:

-How Jesse Elder learned the value of true freedom and learning to live with the consequences of one's decisions…06:30

  • Jesse Elder on Kyle Kingsbury's podcast
  • Raised by parents who more or less allowed him to discover the world on his own terms
  • Discovered martial arts at age 9; quickly devoted his life to it
  • At age 19, had an encounter that left him disillusioned with what he had learned and was teaching re: martial arts
  • Took up jiu-jitsu and amateur fighting at local bars
  • “I have a body, but I'm not my body”
  • Family and friends felt sorry for Jesse Elder when he was beaten, but this was an epiphany for him on the meaning of true freedom
  • Opened highly profitable martial arts centers employing sound business and marketing principles

-Statutory vs. common law and how the legal system has become a weapon of the state…33:00

  • Jesse Elder began studying law in February 2021
  • It's actually illegal for the government to assess and collect a tax on private property
  • The U.S. was founded on what's known as “common law” or “equity law”
  • Each court must be a court of record; magistrate, clerk, jury, etc. aka due process
  • Many forms of law have been added to the common law; has weaponized the legal system for monetary gain
  • If there's no victim, is there a crime?

-What to do if and when you get pulled over for speeding…39:19

  • Keep your hands visible on the steering wheel
  • “What is your emergency?” you say to the cop (lights are emergency lights)
  • Engaging with the script is treading on dangerous ground
  • They're trying to bring you into their fictitious world of jurisdiction
  • Tickets are essentially offers of contract – a request for money
  • Any contract that is enforced or assumed, that you didn't agree to, is a fraud
  • Take the ticket, file an affidavit of status with the magistrate in the jurisdiction you've been pulled over
  • Affidavit of Status forum topic on Alphonse Faggiolo's website iamhassentmetoyou.com

-Fun facts about the IRS and what might happen if you stop filing tax returns…47:11

  • The IRS was founded in 1933, is officially listed as a debt collection agency, and is based in Puerto Rico
  • IRS notices sent through the mail are violating at least 3 federal laws by demanding money via the mail
  • There's no federal law stating an individual must pay tax on their income
  • Fear and heavy conditioning is the cause for more people not being aware of this
  • Questions to ask of the IRS:
    1. Am I the property of you or your employer?
    2. What is the name of your employer?
    3. Is my body mine, or is it under the control of you or your employer?
    4. Have I consented with my signature any obligation or contract where I've relinquished my rights to you or your employer? Have I consented with my signature any obligation or contract agreeing to be governed by your laws, statutes, codes?
    5. Do you have a verified claim to bring to me, from a man or a woman, claiming I have damaged or violated their rights in any way?
    6. Under what authority are you administering my property?

-Resources to begin understanding your rights and sovereignty as an individual…55:45

  • Law dojo
  • Everything taught is subtractive; it's not what we don't know, but what we do know that is patently false
  • Does any human being have more rights than another?
  • Threat, influence, persuasion, manipulation cause us to submit to falsehoods

  1. Dizzy says:

Hey! I believe that human rights should be protected by law. There are controversial cases (learn about them here – https://graduateway.com/human-rights-topics-for-e… ) when human rights are forgotten. For example, for me the phenomenon of the death penalty is a violation of human rights.

  2. Frank says:

That podcast was insane. Agree with the many comments that point out the flaws of law and logic. And also – what is his definition of society? We all do what we want? Does he have a corporation or trademarks or copyrights? Aren’t all those artificial too? Who enforces contracts, protects property and our “natural” persons? And when if his water had lead in it, will he complain to the state (that he didn’t pay property taxes to)? Will he start delivering his own mail? The list is endless. Thoreau advocated “Civil Disobedience” if the state is unjust. Staying true to his philosophy, he refused to pay taxes one year because he didn’t want to support the Mexican – American war. And he was jailed. He didn’t say the state is an artificial entity.

  3. Not Ben says:

Once again this guy is a jerk off and never should have been given this platform .. but Ben is positioning himself that his “freedoms” are being stripped

Please provide an update when this clown gets thrown in the pen for tax evasion

  4. Rick says:

PS – I’m with him on the mask response though. Just not the “sovereign citizen” nonsense.

    1. Fair enough and thanks for the link!

      1. Rick says:

You bet. I do appreciate your willingness to explore edgy topics, nonetheless.

  5. Rick says:

All of the “tricks” that Jesse is recommending here have been tried. Yes, there are nuances in the law. Yes there are loopholes but what he suggests folks try will land you in jail or broke or both. I’ve known some of these “sovereign citizen” types and if they follow through, they all end up in jail and/or bankrupt. Frankly, this is embarrassing. But here’s a video from an attorney that knows what he’s talking about and does give some solid advice when dealing with government officials. The attorney in the video is a professor of law and a former criminal defense attorney. https://www.youtube.com/watch?v=d-7o9xYp7eE

    1. Random says:

Sovereign Citizen is nonsense, the two are diametrically opposed, Blacks Law Dictionary, a citizen is an employee, you’re an example of the slave liking his shackles, if living in a communist dystopia is your cup of tea, keep playing the game and wondering how the ‘elites’ don’t seem to have to play by the same rules.

Ben, I’m over the moon that you’re on to this stuff, I believe we are the tide, the shift in consciousness that can help free humanity, thanks for helping in all the ways you do🙏🏻🙏🏻

    2. Daria says:

I have learned recently that that’s exactly what happens. Playing the system against the system doesn’t work. While I can relate to guys like Jesse, I believe they are on the wrong path as they do not fully understand the extent to which they are entrenched in the system that they try to resist. The only way to fight the system is to get out of the matrix altogether. Easier said than done but there is really no other way.

Great interview! Has anybody here heard about Ones People Public Trust? They talk about Natural Law, very similar to what Jesse talks.

Thanks Ben for making as always great interviews with awesome content!

    1. Glad you enjoyed it Jose!

  8. Patti Stewart-Garbrecht says:

    Ben,

I generally really enjoy your podcasts. But after listening to this one, I have come to the conclusion that your guest is one whisker hair short of bat-shit-crazy. Additionally, he is one of those assholes who believes the rules (whether laws or social mores) don’t apply to him. What kind of society would we be living in if everyone behaved like he behaves? Laws aren’t made to be broken, they are made to support a stable society and a safer place to live. There may not be a victim every time someone is driving 80 in a 55, but eventually there will be a victim (especially if everyone is driving 80). He doesn’t think he should wear a mask? On his own property, he does not. In a airport, the well being of others is a consideration. I am sure that he put on his mask to board the plane because the airlines are privately owned and have the right to require masks. The airport is owned (loosely) by the US government. Does he think because he doesn’t pay taxes that he doesn’t have to follow governmental rules? Another example: Does he think it is important for a surgeon to wear a mask while performing surgery? What if he was about to have an orthopedic procedure done under epidural. He’s awake (because he has an epidural) and notices that the surgeon isn’t wearing a mask. Is going to request the surgeon to put one on? He says “masks don’t work”. Hospitals generally have rules about mask wearing in the operating room (because they DO work to prevent spread of pathogens). But what if that surgeon has the same mentality as Jesse?….the rules don’t apply to me, because you don’t own me. That sounds like something a 12 year old says to a step parent. I am curious to know long he is going to get by with not paying federal taxes. He is living within the US borders. He is benefitting by living in a relatively safe country, thanks to our military (which is federally funded). He wants to talk about freedom? Well FREEDOM ISN’T FREE! Does he keep all his money stuffed under a mattress? Because banks are federally insured. I could go on all day with examples of how he is benefitting from the US government. And I don’t believe vaccines should be mandated. But unfortunately the same people who don’t want to be vaccinated, don’t believe they should be forced to wear a mask. Herein lies the problem. And an even bigger problem is that about 50% of the US population cares more about their “personal freedoms” than about other people.

I am not ready to give up on you yet, but please give careful consideration to future guests with his mentality. From reading the other comments, I am not alone in my opinion of this podcast guest.

P.S. I am not a SJW or a snowflake or some otherwise extreme thinker. I am just a common sense, middle of the road, mom, veteran, nurse midwife, runner, reader, crafter and seeker of information who loves Jesus and the outdoors.

    1. Thank you for this thoughtful feedback Patti! Appreciate your honesty.

  9. Frankie says:

Great Interview. In our current cancel culture where there is only one permitted narrative people can’t handle an outspoken individual who stands up for himself and lives by his own code. Of course I didn’t agree with everything that Jesse had to say but it’s refreshing to hear a man speak his beliefs without fear of the mob.

I’m just curious what you did Jesse when you had to board the plane? Did you wear the mask?

  10. steve says:

Wow. Surprised to see all of the negative comments. I’ve only listened to a few Ben Greenfield podcasts (am reading his excellent book, Fit Soul, right now). But this podcast gave me a whole new load of respect for the man.

Being willing to delve into forbidden topics, and discuss them openly, gets my attention, even if I disagree with some (or many) of the statements and conclusions.

I also like listening to other podcasters, on occasion, such as Russell Brand, as an example. I disagree with about half of his opinions. Sometimes more. Sometimes I completely disagree with him. But when I’m online listening to his podcasts, or Ben’s, or anyone else’s, I’m not necessarily looking for a podcast leader to be an echo chamber for my own beliefs. Instead, I’m looking to expand my understanding — even if it’s just to learn why some folks believe in certain things I don’t necessarily believe.

This helps me accomplish one of my main goals, which is to break out of default mode network, mentally and emotionally — you know, those things that have been ingrained into our minds, often since childhood, that over time have become ‘truth’ in our hearts and minds, but are not necessarily true at all, even though the whole world might believe them.

I refuse to believe things just because the crowd believes them. And because I’ve been willing and able to listen to opinions different than my own, this old desert rat, who didn’t even graduate from Jr. College, has done quite well for myself.

  11. Some Guy says:

I’ve listen for years but the last several months a lot of his personal beliefs are seeping out got extremely narrow minded selfish and disappointing views..
This “guestL is spouting his opinion as fact the whole judge story was ridiculous along with other things people have touched on yeah let’s see what happens if he continues not to pay his taxes
Ben used to seem like he cared about wellness for others .. but I have noticed he’s got a tad testy after Covid an I think it’s mainly due to it impacting his pocketbook as he no longer gets to spout off his rhetoric at well paying speaking gigs every month

  12. Matt says:

Gee, all this advice from Mr. Elder almost sounds too good to be true….oh, wait…bamboozled again. What’s next, multi-level marketing?

  13. Amy says:

    WOW, Ben.

Hey, what happened to that promise to let us know “in thirty days or less” about your personal and family decision regarding the vaccine? I think we can guess. I was probably naive but i was holding out hope that you would stand up for the bigger picture of the social contract (responsibility and personal sacrifice) over “sovereignty” ( new word for selfishness).

    1. Karen says:

      Exactly Amy,

Vaccines prevent spread of Covid as all vaccines do. I don’t understand why people don’t know this. Please vaccinate to prevent the spread to the most vulnerable from Covid, children!

      1. Denet H Lewis says:

        Hi Karen,
You are not correct. Vaccines for Covid do not prevent the spread of Covid .

    2. Did you listen to my podcast with Donnie Yance?

    3. steve says:

Fucking communist. What are you even doing here? And why can’t someone be socially responsible without sacrificing their sovereignty? Have you even thought of that? My wife and I give tens of thousands of dollars annually to charitable endeavors designed to help folks of ever race, color and creed. (Do you? I somehow doubt it. You sound like one of those social justice warrior snowflakes who only want others to take care of them, rather than being responsible for one’s own self.

But my wife and I won’t take that fricken’ jab, because of the deceptions they used (and are still using) to “sell” it. If they have to lie through their teeth to sell a thing, that thing is likely not going to be good for you, or for the society as a whole.

Right now, more of the jabbed are coming down with COVID, than the non-jabbed. So, go figure. And quite frankly, it’s not my job to light myself on fire, just to keep you warm, honey. So take your “social contract” and shove it where the sun don’t shine, honey. It’s YOU who’s selfish.

      1. Amy says:

Misogynist, poor vocabulary or both ?

  14. Jacques Sisquiot says:

As I expected after listening. Most of the commentators are triggered, some have heard this stuff before. Most have not read the classic The Creature from Jekyll Island by G Edward Griffin or None Dare Call it Conspiracy by Gary Allen ( a best seller long ago)

alfred adask has a fantastic story beating his court case for selling colloidal silver. “Man or other animals!” As in, man are to be treated like animals when it comes to drug laws. This violates the idea of man are separate from animals in the God given sense as well as Hod given rights. Your God given rights do not come from government. I guess that leaves atheists out and their rights come from a group of MAN!

Ask yourself, What does the allopathic medical establishment provide you? Go back and listen to Ben’s podcast about the Flexner report. If those same characters creating our health system are crating our banking system. Do you really think they are looking out after your wellbeing?

    1. Daria says:

I wish there were more people like you Jacques, and kudos to Ben for the Flexner report podcast.

  15. Cole says:

I loved this episode. Thank you! It’s amazing how many people are ticked off about the discussion of sovereignty. It’s as if they have a mild case of stockholm syndrome. Cheers from Canada!

  16. Aaron says:

    Ben

This is why we need fact checkers and your world is the last place I expected to see it.

Maybe I’m naive but I expect you to be a steward of your audience.

This information is not only factually incorrect and ignorant but it’s dangerous.

I’d encourage you to consider removing this before you become a lighthouse guiding someone to a rabbit hole of misinformation that could land them in jail and destroy families.

Jail is exactly where someone like this man should end up.

I’ve taken entirely too much life changing information from you over the years to leave as others have stated but please reconsider this source and the validity of the information you’re sharing.

  17. Matt says:

    Ben,

WTF, this guy is a “man after your own heart”?? He’s advocating anarchy!

Unlimited freedom to do as you please is fine if you live on an island in the middle of the ocean. But most human beings on planet earth live in a society. And as a member of a society, each of us are obligated to behave in a certain way for the greater good of order, decency, safety, health, etc. It should come as no surprise that many of these behaviors compromise people’s personal freedoms. Tough shit. If this guy wants to challenge something like his own citizenship, then he forfeits all the rights that go with it, such as using roads that he doesn’t help to pay for, or due process, which looks like he may have to beg for someday.

Your show is called Ben Greenfield Fitness- Maybe you should stay on topic.

    1. Unless I'm under your employment Matt, and last I check I wasn't, I'm free to talk about whatever I want to talk about on my own podcast. :(

      1. Brad says:

I think Matt knows that you’re free to talk about whatever you want. If you want to invite white supremacists, Nazis, or selfish non tax paying anarchists (that use the benefits of society but expect others to pay for them), everyone knows that you’re free to do that. Matt was probably just giving some constructive feedback.

        1. Simon says:

How dare you call Nazis selfish! They were Democratic Socialists just like Bernie! They were looking out for the common man too by providing free education and healthcare. I assume you are a Bernie supporter too, Chad.

          1. Brad says:

            Hey Limon:

Not that I have any good things to say about Nazis, but I did not call them selfish in my post above. If you re-read the post, I labeled non-tax paying anarchists that use society’s benefits as selfish.

You assume incorrectly. I was never a Bernie supporter. I am not for free college. Kids can pay for that themselves if they want it.

I am pro-environment though. Even if you don’t believe in climate change, who likes breathing in pollution? One study found that air pollution is one of the leading causes of death worldwide, far surpassing smoking, malaria, and other significant factors.

            https://www.medicalnewstoday.com/articles/air-pollution-may-be-a-leading-global-cause-of-death

According to another study, pollution kills more people every year than wars, disasters and hunger.

            https://www.thelancet.com/journals/lancet/article/PIIS0140-6736(17)32345-0/fulltext

At least with smoking, that’s a choice, With respect to air pollution, you can’t escape it unless you live in a box with various air filtration devices.

          2. Frankie says:

History is written by the winners. In fact, Germany was the only nation to make a stand against communism. The rest of the world tucked its tail and capitulated to the Soviets because our Governments were infested with colluding Marxists.

We would not be where we are now if we would have finished the job after WWII. The real demon was Stalin.

      2. That’s exactly right, Ben. You do what’s best for you and what’s on your heart to share with the world. People can tune in. Or not.

I, for one, am thrilled that you are putting out one episode after the next that challenges pre-conceived notions about health, fitness, and who we are on this planet.

      3. Matt says:

        Ben,

Hey man, I’m stoked you have this podcast. I consume it voraciously and it’s is a big reason why I have become passionate about all things related to fitness, longevity, biohacking, etc. What has always been refreshing about your podcasts is that it is one of the very few “places” I can go these days and not have to hear about politics. As it turned out, this was the first podcast of yours that I literally turned off half-way though; and from the sounds of it, I wasn’t alone. I’m one guy with one opinion, but I care enough about what you do to give you my feedback, even if it’s negative.

      4. Daria says:

absolutely Ben! Matt forgot about something called ‘freedom of speech’

    2. steve says:

Anarchy is not “unlimited freedom to do as you please.” Anarchy simply means self-rule. It’s the height of being human, i.e., putting yourself under the microscope, so to speak, and constantly discovering your strengths so you can grow them, and discovering your weaknesses so you can strengthen yourself where you’re weakest, and, in the process, fine-tuning yourself into a responsible and self-reliant adult in the process.

The general rule of anarchy is: “I have the right to swing my fist, but that right ends just short of your nose.” In other words, be responsible to self, do no harm to others. What the fuck can possibly be wrong with that?

Your definition of anarchy was apparently spoon-fed to you from the ruling authorities, likely via the public school system, who want you dependent (and co-dependent) on them, because you’re easier to control. You can never reach your full human potential if you’re dependent on government to tell you how to live, act, work, etc.

      1. Brad says:

What you wrote in quotes below is a noble goal:

” . . .putting yourself under the microscope, so to speak, and constantly discovering your strengths so you can grow them, and discovering your weaknesses so you can strengthen yourself where you’re weakest, and, in the process, fine-tuning yourself into a responsible and self-reliant adult in the process.”

However, it seems to me that you created your own definition of Anarchy. Here is Merriam Webster’s Dictionary definition:

        Definition of anarchy
        1a: absence of government
b: a state of lawlessness or political disorder due to the absence of governmental authority
        the city’s descent into anarchy
c: a utopian society of individuals who enjoy complete freedom without government
2a: absence or denial of any authority or established order
anarchy prevailed in the war zone
b: absence of order : DISORDER
not manicured plots but a wild anarchy of nature

To my knowledge, you don’t have the right to swing your fist, just short of someone’s nose in any state unless it’s in self defense or the two individuals are involved in a form of voluntary sparing. Otherwise, the action would be assault. The rationale for assault laws is that we don’t want individual to terrorize others. Would you be ok if some dude threw a punch at your mom, daughter, or wife but stopped just short of their nose with the intent to scare or terrorize them? What if they intended to stop just short, but oops, they goofed and broke your loved one’s nose? What if you son threw the punch (only intending to terrorize some other kid) and was knifed in response to the thrown punch?

I am ok with anyone putting themselves under the microscope provided they do no harm, pay their fair share, of taxes and not be a leech to society. If you’re going to use the roads, be prepared to chip in and pay for them.

For people that don’t want to pay taxes for roads and other societal benefits, and do not wish to take advantage of such benefits, there is vast wilderness in the world where they can go live away from society. A man can be completely be free, but he does not have to be a leech.

        1. Joe Mamma says:

Well said! But I wouldn’t even give any of this the title of Anarchy. This guy discusses how he 1. Hasn’t paid taxes (and admitted he doesn’t know what will happen. 2.“owned” a security guard At an airport who’s salary probably isn’t worth it. (Why didn’t he discuss what happened with TSA or when he got on the plane? But we all know why) and 3. Several anecdotal evidence talk tracks that I’m sure are BS and passed around his band of “bandits”. Almost every time he was asked a question, he provided a story someone told him, or what he “would” do, or a story that has yet to reach legal repercussions. Big deal. Let’s see proof!

Ben, it would be great to bring on opposing views for shows, like you having a discussion with someone who can share with this guy is wrong. Or more importantly a qualified individual who supports masks, opposes ivermectin etc. Dont you think everyone should learn from both sides, including you? Just hate it when good shows become echo chambers and fail to discuss from both sides. Either way, love your fitness discussions, and good luck to you.

  18. Randy Goldberg says:

Great, don’t pay your income taxes, read the cops a script, and don’t pay your property taxes. Let me know how that FREEDOM goes.

    🦈 jumping…engage.

  19. Ian says:

What about the fact that these rules and taxes exist for the benefit of all of us. They are not a tyrannical control tactic that has no reason to be. As adults we need to take personal responsibility to our community and society, following these rules is in most cases how we do that. If we were all perfect and could fully live in this responsibility to others there would be no need for laws and taxes, but this is not the case and is fully evident in this guest. Wearing a mask protects other people who are more concerned about the virus than you. Sure there are situations where masks seem overkill but an airport seems reasonable, it’s not that hard. Why Ben did you have zero push back as a decent interviewer would despite your personal opinions? Not to mention the lack of credibility of this guest.

    1. Frankie says:

Did people not take care of themselves and their community before “taxes.” They are tyrannical control. It’s theft by force.

Please link to the study that shows wearing a mask protects people because there are dozens of studies at CDC that say otherwise.

      1. Brad says:

The mask issue is not really my thing, but since you asked for a study, here is an article published the premier science journal in world, Nature. Nature is known to have the strictest publication standards, at least according to Dr. Andrew Huberman. The article links to the study in the footnotes

“In a review of observational studies, an international research team estimates that surgical and comparable cloth masks are 67% effective in protecting the wearer.”

        Nature 586, 186-189 (2020)

        https://www.nature.com/articles/d41586-020-02801-8

        1. Frankie says:

That is an article citing and quoting other “studies.” If you look at the cited studies and read deeper, the results are not what you expect. Of course, using them to come to the “wanted” conclusion is pretty easy for the author(s) of the article.

  20. Mark K Stansbury says:

Let me help you guys out:

26 USC 1(a) (Section 1 of the Internal Revenue Code):

“There is hereby imposed on the taxable income of—
    (1) every married individual (as defined in section 7703) who makes a single return jointly with his spouse under section 6013, and
    (2) every surviving spouse (as defined in section 2(a)),
a tax determined in accordance with the following table: …”

Subsections (b) and (c) cover head of household and unmarried filings.

    26 USC 63

“… the term “taxable income” means gross income minus the deductions allowed by this chapter…”

    26 USC 61

“… gross income means all income from whatever source derived…”

I have no doubt that Mr Elder has us “own set of information and beliefs,” but as for the law he may want to study it a little longer before opining in public. The IRS routinely prosecutes and imprisons individuals who follow his advice.

We need more like yourself to start educating themselves to stand for their rights and others!Q We are not these corporations property!
I am actually a states coordinator for the American States Assembly and if people want to find some answers, solutions, and remedy to all of this, then it’s my responsibility to send all men and women to https://www.theamericanstatesassembly.net/
We need to participate and self govern our republic like it was meant to be and NOT let these corporate public service providers (a.k.a.) Federal/Municipal Agencies tell US what we can or cannot do!
We the People WILL make this country right again!
    Godspeed!

Ben, Hard to believe that you would have this person on here. His credential’s say he started studying law in 2021. How long has he actually been studying? 1 month? He says the IRS was founded in 1933, It was founded in 1862, Google it! and since when is it based in Puerto Rico? What to do when you get pulled over by a cop? I’m usually very respectful and thankful and that’s always worked. Rights of sovereignty? I had to stop. This post does not belong here. This guy is advocating dangerous and self destructive behavior. You owe your community an apology.

  24. R says:

Bye Ben. You’ve jumped the shark.

  25. Susan Peroutka says:

I agree with the previous comment from Kyle. This interview is absurd and doesn’t belong on this site.

Ben – what a disappointment. I have been a long time listener and have benefited from much that you have shared but lately I’ve been tuning out before I can get through the whole episode. I think you’ve gotten way off track. What a shame.

Good one Ben Greenfield The difference between common law God’s rules and commercial law men’s made up rules.

    1. Brad says:

As used in legal systems, common law is law made by a Judge or panel of judges through a judicial decision. The law is often followed through precedent until it is overruled by statue or by subsequent judicial decision.

It boggles my mind as to why one would think that Common Law or Statutory Law is superior to the other. They both have their purposes, advantages, and disadvantages. By the way, the Constitution is more similar to statutory law than it is to common law, as it was created by a body of law makers instead of a court.

    Checkout Postmaster-General: Russell-Jay: Gould
For the claim of the life.
He has a film: last flag standing and he explains what he did.
    Fascinating.

  28. Brad says:

American law is made up of both common law (made by judges) and statutory law (made by legislative bodies). Jesse spewing nonsense and untruths that property tax is illegal and that you may not be ticketed unless you agree by contract. Each of you appear to have no understanding of the American legal system whatsoever.

Jesse: If you keep following your own advice (e.g., don’t pay taxes, speed or drive drunk and expect no consequences) and you will eventually disseminate your untruths from Jail. Those who follow your advice will likely end up in jail.

Ben: So are you going to stop paying your taxes? Please have your own lawyer listen to this podcast. It should be taken down since it is so full of misinformation

    1. Jesse Elder says:

I appreciate your passionate perspective, Brad.

May I assume that we are each operating from different information and beliefs?

Perhaps if we were drawing from the same information and beliefs we’d see things more similar.

As it is, I’m quite content to explore and learn as I go, with the principles of “Do no harm, take no crap” as my guide.

      1. Brad says:

        Jesse:

The way I see it, your principles are selfish and do cause harm, particularly if they are applied generally to society

If we permit people to speed or drive drunk without penalty as you seem to suggest, that will dramatically increase the number of innocent deaths. Without penalties, more people will drive drunk, more people will speed, and more innocent people will die. The penalty is there to discourage reckless behavior. If you study the law, you have undoubtedly learned that driving is a privilege and is not a right. As of such, you must follow local government rules if you want to drive.

It seems that you do enjoy the privilege of driving on roads, but do not want to pay your fair share of taxes to pay for them. I am guessing that you expect everyone else to pay for them except for you and your non-tax paying compatriots.

Likewise, in an emergency, police officers, firefighters, and the military are there to protect you and your family and the remainder of the country. However, it seems that you would prefer to let others pay their salaries through their taxes.

If everyone had the same attitude as you, there would be no military, no police, no schools, no fire department, and no country (we would be invaded due to a lack of military) because no one paid taxes.

        1. Kyle says:

          Exactly.

Honestly, this was the final straw for me as a listener. I have enjoyed this podcast for a long time now, but I have found myself shutting it off in frustration more than it’s worth.

      2. Brad says:

While most listeners probably intuitively understand this, Jesse misstates the crime and tort of Battery. It should be noted that in all or most states, an element of Battery is unlawful touching. The key word here is “unlawful.” It is lawful in most instances for a police officer to use reasonable efforts to physically restrain you and to arrest you if you violate laws and you flagrantly fail comply with their instructions to abide by such laws. Such restraint and arrest is not battery.
